These Terms & Conditions apply to all purchases made on www.geminiatelier.com.


2. Scope & Acceptance

By placing an order on our webshop, you confirm that you are at least 18 years old (or have parental consent) and that you accept these Terms & Conditions.

These Terms apply to B2C sales only.


3. Products & Availability

Gemini Atelier sells physical products, including baby and children’s clothing, toys, and design objects.

All product descriptions, images, and prices are provided to the best of our ability. Minor variations in color, material, or appearance may occur due to screen settings or production changes.

All products are subject to availability.


4. Prices & Payment

All prices are shown in DKK or EUR and include VAT, unless otherwise stated.

Shipping costs are calculated and displayed at checkout.

We accept the payment methods listed on the webshop.
Payment is captured after order fulfillment (for products in stock) or immediately (for preorder products).

Payments during temporary store closures

During periods where the webshop is temporarily closed for holidays or operational reasons, orders may still be accepted even though shipment will take place after the store reopens.

In such cases, payment may be captured at the time the order is placed and before shipment. This is necessary because payment authorisations issued by our payment provider may expire if payment is not captured within a certain timeframe.

Customers will always be clearly informed on the webshop when the store is on holiday and when orders are expected to ship. If you do not wish to have your payment captured before shipment during such periods, you may choose not to place an order or contact us to cancel your order before it is dispatched, in accordance with your cancellation and withdrawal rights.

This does not affect your statutory rights under applicable consumer law, including your right of withdrawal.


5. Preorder Products

Some products are offered as preorders, meaning they are not yet in stock at the time of purchase.

For preorder items:

  • Estimated delivery dates are indicative and non-binding

  • Delays may occur due to production or logistics

  • You may cancel a preorder at any time before shipment for a full refund

  • If delivery is materially delayed, you are entitled to cancel your order and receive a full refund

We will keep you informed of significant changes to delivery timelines.


6. Delivery

We deliver primarily within Denmark and the EU.
International (non-EU) deliveries may occur on a limited basis.

Delivery times are estimates and not guaranteed.

Risk Transfer

The risk of loss or damage to goods transfers to you only when you physically receive the goods.


7. Right of Withdrawal (EU Consumer Right)

As a consumer, you have the right to withdraw from your purchase within 14 days without stating a reason.

Withdrawal Period

The withdrawal period expires 14 days after the day you receive the goods.

How to Withdraw

To exercise your right of withdrawal, you must notify us clearly (e.g. by email) before the withdrawal period expires.

Return of Goods

  • Goods must be returned without undue delay and no later than 14 days after you notify us

  • You are responsible for return shipping costs

  • Returned items must be unused and in original condition

Refund

  • We will refund all payments received from you, including standard delivery costs (not if your order qualified for free shipping)

  • Refunds are processed within 14 days from receiving your withdrawal notice

  • We may withhold the refund until goods are returned


8. Returns & Refunds (Defective or Incorrect Products)

Under Danish law, you have a 24-month right to complain about defective products.

If a product is defective or incorrect:

  • Please contact us as soon as possible

  • We will cover return shipping costs

  • Remedies may include (in this order) repair, replacement, or refund, in accordance with applicable law

Complaints must be made within a reasonable time after discovering the defect.


9. Non-EU Orders

For deliveries outside the EU:

  • Customs duties, taxes, and import fees are the customer’s responsibility

  • Delivery times may be longer and subject to local customs procedures

  • The right of withdrawal still applies unless local law provides stronger rights


10. Order Cancellation by Gemini Atelier

We reserve the right to cancel an order in cases such as:

  • Pricing errors

  • Stock unavailability

  • Suspected fraud

If we cancel your order, you will be notified and fully refunded without delay.


11. Liability

Gemini Atelier is not liable for indirect or consequential losses.

Nothing in these Terms limits or excludes liability for:

  • Personal injury or death caused by negligence

  • Gross negligence or willful misconduct

  • Rights that cannot be excluded under applicable consumer law

All products are provided in accordance with mandatory consumer protection legislation.


12. Intellectual Property

All content on this webshop, including text, images, designs, and logos, is the property of Gemini Atelier or its licensors and may not be used without prior written consent.

These Terms & Conditions are governed by Danish law.
